RTK Productions Terms & Conditions

1.       Acceptance of Terms of Use
This Web Property is operated by RTK Productions, INC., a Florida corporation. By your use of the Site, you are agreeing to comply with and be bound by the terms set forth in this agreement. This agreement constitutes the entire agreement between RTK Productions and you, and supersedes all prior or contemporaneous, representations, warranties and understandings with respect to the Web Property.

2.       Modification to Terms of Use
RTK Productions reserves the right to update or modify these Terms and, any additional terms, codes of conduct or guidelines, without prior notice. You are responsible for regularly reviewing these Terms and Your continued use of the Websites constitutes Your agreement as to all such updated or modified terms.

Except as set forth herein, none of the Content may be copied, reproduced, framed, modified, removed, sold, distributed, republished, downloaded, displayed, posted, transmitted, or otherwise exploited, in whole or in part, in any form or by any means, including, but not limited to, electronic, mechanical, photocopying, recording, or otherwise, without the prior express written permission of RTK Productions.

3.       Responsibility for Your Site
 You will be solely responsible for the development, operation and maintenance of your site(s) and for all materials that appear on your site(s). We shall have no responsibility for the development, operation and maintenance of your site(s) and for any materials that appear on your site(s). You shall also be responsible for ensuring that materials posted on your site(s) do not violate or infringe upon any laws including, but not limited to the rights of any third party (including, for example, copyrights, trademarks, privacy, or other personal or proprietary rights), and ensuring that materials posted on your site(s) are not libelous or otherwise illegal (including depictions of actual, implied or simulated bestiality, rape, incest, child pornography, or any other content deemed inappropriate or illegal). You must have express permission to use another party's copyrighted or otherwise proprietary material. We will not be responsible if you use another party's copyrighted or otherwise proprietary material in violation of the law.

You must be at least 18 years of age (or 21 years of age where 21 is the age of majority in your country/state) to sign up or use the RTK Cash programs.

         SPAMMING IS NOT ALLOWED!

No exceptions, we will withhold all funds, and delete accounts of person(s) believed to be involved in spamming or abusing the RTK Productions system

As an RTK Productions webmaster, you agree to receive RTK Cash news and update information

US citizens are required to provide a Federal Tax ID or Social Security Number before commission payments can be made to you. RTK Affiliate Program will register a 1099 for all U.S. domestic entities or a 1042-s for all foreign entities to whom we issue combined yearly payments of $600.00 or more. Any falsification of Social Security or Tax ID numbers shall be cause for denial of payment and immediate account termination. It is the responsibility of the Affiliate to keep all account information with RTK Affiliate Program up-to-date and accurate.

4.       Commissions
All funds are paid in American Standard Dollars (USD). All commissions are summed up at 1:00 PM on the 16^th  day of the month. Checks will be sent out by the 16^th  day of the following month.

We cannot and will not be held responsible for loss of monies, clicks or other due to downtime, damages resulting from complications with our hosting providers, riots, acts of god, server based problems, or any other issues that may arise.

5.       Limitation of Liability
We will not be liable for indirect, special, or consequential damages, or any loss of revenue, profits, or data, arising in connection with this Agreement or the RTK Affiliate Program, even if we have been advised of the possibility of such damages. Further, our aggregate liability arising with respect to this Agreement and the RTK Affiliate Program will not exceed the total commissions paid or payable to you under this Agreement.

6.       Representations and Warranties
You hereby represent and warrant to us that this Agreement has been duly and validly accepted by you and constitutes your legal, valid and binding obligation, enforceable against you in accordance with its terms. You further represent and warrant that the execution, delivery and performance by you of this Agreement are within your legal capacity and power, have been duly authorized by all requisite action on your part, require the approval or consent of no other persons, and neither violate nor constitute a default under (i) the provision of any law, rule, regulation, order, judgment or decree to which you are subject or which is binding upon you, or (ii) the terms of any other agreement, document or instrument applicable to you or binding upon you.

7.       Indemnification
You agree to indemnify, defend and hold Innovative and its respective directors, officers, shareholders, employees, agents, attorneys, advertisers and publishers harmless from any liability, loss, claim or expense, including reasonable attorneys’ fees, related to your use of the Site or violation of this agreement.
